The Telangana RERA authority penalised developer Pacifica Constructions for booking and allotting a flat in its Miyapur project before the project was registered under the RERA Act, as required by law. The order is a separate case from other recent Telangana RERA pre-registration violations and reinforces the regulator's scrutiny of early bookings on unregistered projects in Hyderabad.
What this changes for a title check
Pre-registration bookings are a recurring pattern in Hyderabad's real estate market that this order flags again: a buyer who books or pays for a flat before a project's RERA registration number is issued has effectively entered into an agreement the law treats as unauthorised, and any title check on such a unit should confirm the actual RERA registration date against the date the buyer's booking or agreement was signed, not just whether the project is registered today.
For a lawyer reviewing a resale of a Miyapur unit from this specific project, or advising a new buyer in any Pacifica Constructions project, the practical step is to pull the project's RERA registration certificate and compare its issue date to the booking or allotment letter date on the unit in question. A gap between the two, as found here, exposes both the original buyer and any subsequent purchaser to uncertainty about whether the underlying booking was ever validly made, even if a formal sale deed was eventually executed after registration.
