Poramboke Land: Meaning, Types and How to Check Before Buying (2026)

Last verified 28 Oct 2026 against the Kerala Land Conservancy Act, 1957, the Tamil Nadu Commissionerate of Land Administration (cla.tn.gov.in), G.O. (Ms) No. 540 of 2014 on tn.gov.in, the Tamil Nadu land records portal (eservices.tn.gov.in), the Supreme Court's ruling in Jagpal Singh v. State of Punjab (2011) and reported High Court decisions.

Poramboke land is government land that is not assessed to land revenue and is kept for public or communal use, such as roads, tanks, channels, river beds, markets and burial grounds. Because it belongs to the government, a private sale deed, a long occupation or even a building on it does not give the buyer good title. Before you buy in Tamil Nadu, Kerala, Andhra Pradesh or Telangana, check the survey number against the government land and poramboke records, and walk the boundaries against the survey sketch.

Poramboke land at a glance

QuestionShort answer
What is poramboke land?Unassessed government land reserved for public purposes or communal village use
Where is the term used?Tamil Nadu, Kerala and Andhra Pradesh land law and records (Kerala defines it in statute)
Can it be sold privately? No. It is government property. A private sale gives no title.
Can it be registered?A registration can still happen by mistake, but registration does not prove ownership
Can encroachers get patta? Not on water bodies in Tamil Nadu. Other cases depend on state orders and court rulings.
How to check in Tamil Nadueservices.tn.gov.in: the government poramboke land service, the A-Register and the FMB sketch
Natham porambokeVillage house-site land. Courts treat it differently from communal poramboke. See below.

What is the meaning of poramboke land?

The best legal definition is in Section 4(1) of the Kerala Land Conservancy Act, 1957. It says "poramboke" means "unassessed lands which are the property of Government", used or reserved for public purposes or for the communal use of villagers, such as:

  • public roads, streets, lanes and pathways, with bridges, ditches, dykes and fences on or beside them;
  • the beds and banks of rivers, irrigation and drainage channels, traffic canals, tanks, lakes, backwaters and water courses;
  • markets, burial grounds and landing ghats; and
  • any other property the government declares to be poramboke.

The Act's purpose, in its long title, is "to check the unauthorised occupation of Government lands". Section 5 says it is not lawful for any person to occupy land that is the property of the government without permission.

In plain English, poramboke is land outside the revenue account. It was never given to a private holder for cultivation, so no land revenue was assessed on it. Madras High Court rulings, as collected in a legal commentary, trace the word to poram (outside) and poke (the revenue record). In Tamil it is written புறம்போக்கு.

What are the types of poramboke land?

Poramboke is grouped by the public use it serves. The table lists the groups that appear in the Kerala definition, Tamil Nadu government orders and the Supreme Court's 2011 ruling.

TypeExamplesRisk for a buyer
Water-course porambokeTanks, lakes, ponds, rivers, channels, and in Tamil Nadu kulam, kuttai and odaiHighest. Tamil Nadu has banned regularisation of encroachments on these since 1987.
Road and path porambokePublic roads, lanes, cart tracks, pathwaysVery high. A road cannot be privately owned.
Burial and cremation groundBurial grounds, burning groundsVery high. Communal use.
Village common landGram Sabha or panchayat land kept for the village, such as a village pondHigh. The Supreme Court has said this land must stay for common use.
Market and landing placesMarkets, landing ghatsHigh
Natham (village site) porambokeVillage house sitesMixed. Case law treats it differently. Needs a lawyer's reading.
Other declared porambokeAny land the government declaresDepends on the notification

What is natham poramboke land?

Natham (also written nattam) is the village habitation site, as opposed to farmland. The Tamil Nadu land records portal keeps separate "rural" and "natham" records for patta, chitta and the A-Register.

Courts in Tamil Nadu have long treated natham differently from communal poramboke, but the law is not settled. Older Madras High Court decisions, starting with Rengaraja Iyengar v. Achikannu Ammal (1959), held that a house site in gramanatham is not government property under the Tamil Nadu Land Encroachment Act, 1905. In April 2025, a single judge (N.S. Krishnamoorthi v. District Collector, 2025 LiveLaw (Mad) 124) held that occupied grama natham land that the State has recognised, for example through successive transfers, is the occupant's private property, while unoccupied natham vests in the State. The same ruling disagreed with an earlier Division Bench decision that had taken the opposite view.

So natham poramboke is not automatically safe, and not automatically lost. Ask for the natham patta or the natham survey record, and get a lawyer to read the history.

Why does a title over poramboke land fail?

A title is only as good as the first owner in the chain. With poramboke, the first owner is the government, and the government never sold it. Five rules make this worse for the buyer.

  1. Long occupation does not help. In Jagpal Singh v. State of Punjab (28 January 2011), the Supreme Court said that the common interest of villagers "cannot suffer merely because the unauthorized occupation has subsisted for many years". It held that government orders allowing sale or allotment of such common land to private persons are illegal. It directed every State to prepare schemes for speedy eviction of unauthorised occupants of Gram Sabha, Gram Panchayat, poramboke and shamlat land. Regularisation is allowed only in exceptional cases, such as leases to landless labourers or members of Scheduled Castes and Scheduled Tribes, or where a school or other public utility already stands.
  2. Water bodies are not regularised in Tamil Nadu. The Commissionerate of Land Administration says that G.O. (Ms.) No. 41, Revenue Department, dated 20 January 1987 banned regularisation of encroachments on water-course land such as kulam, kuttai, odai, channels and catchment areas. G.O. (Ms.) No. 186, dated 29 April 2003 told officers to follow those orders scrupulously, and the Madras High Court (W.P. No. 20186 of 2000) directed that such encroachments be identified and the land restored after eviction. In 2016, the state told the Madras High Court that the question of issuing pattas or regularising encroachments on these water bodies "does not arise".
  3. No alternative land for encroachers. In 2022, the Madras High Court (S. Karthikeyan v. District Collector) refused to endorse alternative land for encroachers on a water tank. It said doing so without a statutory provision would promote encroachment.
  4. Bills and tax receipts do not cure it. In February 2026, the Andhra Pradesh High Court (Thota Venkatadri v. State of Andhra Pradesh, 2026:APHC:1684) upheld the eviction of occupiers of land classed as government poramboke (canal land and a burial ground) in Vijayawada. It held that long possession does not legalise encroachment, that property tax, electricity and water connections do not create ownership, and that encroachers cannot claim land acquisition compensation.
  5. Registration does not cure it. A sale deed can be registered by mistake. Registration records a transaction. It does not prove ownership.

If you are looking at a flat or plot near a lake or channel, read our guide on a flat with patta and approval on a former waterbody.

One caution the other way: a "poramboke" entry in one old register is evidence, not always a final verdict. If the seller has a strong old patta, get the full history read before you walk away.

How do I check if land is poramboke?

In Tamil Nadu

  1. Open the land records portal at eservices.tn.gov.in. The service labels are in Tamil.
  2. Use அரசு புறம்போக்கு நில விவரம் பார்வையிட (view government poramboke land details). Select the district, taluk and village, and check the survey number and every sub-division.
  3. Open the A-Register (அ-பதிவேடு) for the same survey number. It shows the classification of the land.
  4. Open Patta/Chitta and the FMB sketch. Check that the seller's extent sits inside the patta land, not on an adjoining channel, road or tank.
  5. For a village house site, use the natham tab of the same services.
  6. Match all of this with the title deeds and the patta and khata details.

In Kerala

Ask the Village Office for the land's classification in the Basic Tax Register (BTR) and the survey sketch. The BTR records, for example, whether land is nilam (paddy land) or purayidam (dry land). Ask in writing whether any part of the survey number is poramboke or other government land. Our guide to revenue records explains the register entries.

In Andhra Pradesh and Telangana

Poramboke is government land. In both states, property owned by the government is covered by clause 22-A(1)(b) of the prohibited property lists under the Registration Act. Run the free searches described in our prohibited property list guide. Then read the land classification in the adangal or ROR-1B on Meebhoomi (Andhra Pradesh), or "Details of Land" on Bhu Bharati (Telangana). A parcel missing from the 22-A list can still show as government land in the revenue record.

Red flags that point to poramboke

  • The plot is next to a tank, channel, river or road, and the boundary on the deed reads "poramboke". The plot may have crept into it.
  • The seller's extent is bigger than the patta extent. The extra land may be poramboke.
  • The seller has only possession, an electricity bill or a tax receipt. These do not prove title.
  • The deed calls it "natham" but there is no natham patta or survey record.
  • The price is far below nearby patta land. Cheap land near water is often cheap for a reason.
  • The seller promises patta "after registration". See the FAQ below.

Frequently asked questions

What is poramboke land?

Government land that is not assessed to land revenue and is kept for public or communal use, such as roads, water bodies, markets and burial grounds. The Kerala Land Conservancy Act, 1957 defines it in Section 4(1).

What is the meaning of poramboke land in English, Tamil and Telugu?

In English, it means government common land outside the revenue account. In Tamil it is written புறம்போக்கு. Andhra Pradesh uses the same term: in 2026 the Andhra Pradesh High Court dealt with canal and burial-ground land "classed as government poramboke" in Vijayawada.

Can poramboke land be sold or registered?

It cannot be sold by a private person, because the owner is the government. If a deed is registered by mistake, the buyer still gets no title against the government.

Can we get patta for poramboke land?

Not for water-course poramboke in Tamil Nadu: the state has banned regularisation of encroachments on kulam, kuttai, odai and channels since 1987. For other land, it depends on current state orders and the Supreme Court's limits in Jagpal Singh. In 2016, Tamil Nadu told the Madras High Court that a January 2008 order on regularisation applied to other porambokes, not water bodies. Check the current order with the Tahsildar.

Is natham poramboke land safe to buy?

It needs a lawyer's reading. Many Madras High Court rulings say occupied gramanatham house sites are not government property, but at least one Division Bench took the opposite view, and the point may go to a larger bench. Ask for the natham patta and survey record.

How do I complain about a poramboke encroachment in Tamil Nadu?

Petition the Tahsildar or District Collector. Under G.O. (Ms) No. 540, Revenue Department, dated 4 December 2014, Tamil Nadu set up redressal committees at taluk, division and district level for petitions on encroachments of government land.

Does a clean encumbrance certificate rule out poramboke?

No. An encumbrance certificate lists registered transactions. It does not show the land classification. Check the poramboke and A-Register records separately.

Before you pay an advance

Pull the poramboke list, the A-Register and the survey sketch for the exact survey number, then walk the boundaries. If anything touches a tank, channel or road, stop and get it checked. LegiScore offers title search reports and legal opinions on legiscore.in.
